The U.S. Supreme Court has overturned a landmark 1986 ruling that forbid the police from questioning suspects without their attorney present. The 1986 case, Michigan v Jackson, was overturned on Tuesday in a 5-4 ruling (PDF) in a similar case, Montejo v Louisiana.
As I reported last month, the Obama administration had sided with the state of Louisiana in that case and argued for overturning the prior...

I'm Disppointed Obama hasnt begun the effort to Overturn DODT, but where ...
(29 May 2009)
Every single person who is discharged because of this ridiculous policy, gets me more and more pissed off. I'm disappointed Obama hasnt started the effort of overturning it by now, and I say effort because I want to see this go through Congress, not be an executive order. That said, where the hell is Congress? If they think he is waiting too long, which he is in my opinion, why havent they made the effort to overturn DODT? Why havent the more liberal members of Congress pushed for it yet? Where...

California's Prop 8- should it be overturned??
(23 May 2009)
I was just browsing through PerezHilton's website, and I spotted something on Prop 8. The Supreme Court of California will rule soon on Prop 8, I believe this Tuesday.
Which got me thinking, what is the right decision in your opinion??
1) Against Prop 8: On the one hand, equal rights for all is a natural extension of rights. Discrimination is bad and should not be allowed etc.
2) For Prop 8: On the other hand, the people of California have spoken by voting for Prop 8. I think it's the right of a...

Sotomayor has had a large number of her opinions overturned
(26 May 2009)
Yes that was what I was hearing on Fox.. had to tune it in to see what those jabberwockeys were saying..
Turned back to CNN I think.. Their commentator was saying she has had one overturned by the supremes, and another one is waiting for final clarification.
For someone who has been on the bench as long as this woman has.. she has the most judicial experience of any nominee in 70 years.. I would thing there would have been a number of times that her opinions would have been challenged.
This coul...

Supreme Court Overturns Sotomayor Ruling
(29 Jun 2009)
Perhaps if she had ruled on what the law requires instead of what her "experience" taught her was "fair", then this wouldn't have happened.
Judge's making decisions by feelings does not work.

The Supreme Court just overturned Sotomayor!
(30 Jun 2009)
"The Supreme Court ruled Monday that white firefighters in New Haven, Conn., were unfairly denied promotions because of their race, reversing a decision that high court nominee Sonia Sotomayor endorsed as an appeals court judge.
New Haven was wrong to scrap a promotion exam because no African-Americans and only two Hispanic firefighters were likely to be made lieutenants or captains based on the results, the court said Monday in a 5-4 decision. The city said that it had acted to avoid a lawsuit...

SCOTUS Overturns Something Huge
(27 May 2009)
The Supreme Court overturned a long-standing ruling that stops police from initiating questions unless a defendant's lawyer is present, a move that will make it easier for prosecutors to interrogate suspects.
READ: Arguments | Opinion
This was a 5-4 ruling with the conservative/liberal divide.
"The police interrogation in this case clearly violated petitioner's Sixth Amendment right to counsel." Justice Stevens, writing in dissent
"Because of the protections created by this court in Miranda and...

Rochester's curfew on teens overturned
(09 Jun 2009)
ALBANY - The state's highest court today overturned Rochester's nighttime curfew that forbids children under 17 to be in public places overnight in most instances.
"The issue before the court is whether the juvenile nighttime curfew adopted by the Rochester City Council violates the federal and New York state constitutions. We hold that it does,'' Judge Theodore Jones wrote for the five-member majority. Two judges voted to retain the curfew.
The City Council adopted the curfew in 2006 to try to...
